These Terms of Service govern your use of Photo Markt, a marketplace that connects sports photographers with the people they photograph. By creating an account, browsing events, uploading photos, or buying photos, you agree to these Terms. Please read them together with our Privacy Policy.
By accessing or using Photo Markt you confirm that you can form a binding contract and that you accept these Terms and our Privacy Policy. If you do not agree, please do not use the service. If you use Photo Markt on behalf of an organization, you confirm that you are authorized to bind that organization.
You sign in with Google and can act as a photographer, as talent (the person photographed), or switch between both roles from your dashboard. You are responsible for keeping your account secure and for all activity that happens under it.
Photographers can use Photo Markt on a free plan or on a paid subscription. Each plan has a monthly price and a commission rate on sales, shown on our pricing page and in your billing settings. Paid subscriptions renew automatically until cancelled, and you can manage or cancel yours at any time from your settings.
You keep ownership of the photos you upload. By uploading, you grant Photo Markt a non-exclusive, worldwide license to host, process, watermark, resize, display previews of, and deliver your photos as needed to operate the marketplace and complete sales. You are responsible for the content you upload and for holding the rights and permissions needed to sell it.
When you purchase a photo, you receive a personal, non-exclusive, non-transferable license to use that photo for your own personal, non-commercial purposes. The photographer keeps the copyright unless they agree otherwise with you directly, and commercial use requires their separate permission.
Prices are shown before you pay. Payments are processed by Stripe, and we do not store your full card details. You are responsible for any taxes that apply to your purchases or, for photographers, to your earnings. Photo Markt charges a platform fee and, where applicable, the plan commission, as described on our pricing page.
Photos are digital goods delivered immediately after payment, so purchases are generally final once the full-resolution file has been made available. If a photo is faulty, was charged in error, or there is another problem with your order, contact us and we will review it in good faith and in line with applicable consumer law.
The optional "find my photos" feature lets you upload a selfie to find pictures of yourself at an event. Your selfie is sent to AWS Rekognition for a single similarity search and is not stored by Photo Markt. Face indexing is enabled per event by the photographer and is excluded for events that may involve minors. By using this feature you consent to the processing described in our Privacy Policy.

Photo Markt, including its name, logo, software, and design, belongs to us or our licensors and is protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or platform beyond using the service as intended. Photos remain the property of their respective photographers.
Photo Markt is provided "as is" and "as available," without warranties of any kind to the extent permitted by law. We do not guarantee that face search will find every photo of you, or that the service will be uninterrupted or error-free. To the maximum extent permitted by law, Photo Markt is not liable for indirect or consequential damages, and our total liability for any claim is limited to the amount you paid through the platform in the twelve months before the claim. Nothing in these Terms limits rights that cannot be limited under applicable law, including mandatory consumer rights.
You can stop using Photo Markt and close your account at any time. We may suspend or terminate access if you breach these Terms, misuse the service, or where we are required to by law. Some records, such as completed orders, may be retained as described in our Privacy Policy and as required for legal and accounting purposes.
We may update these Terms as the product evolves. When we make material changes, we will update the date at the top of this page. Continuing to use Photo Markt after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the country in which the operator of Photo Markt is established, without affecting any mandatory consumer-protection rights you have where you live. If you are a consumer in the EU, you keep the protection of the mandatory provisions of your country of residence. The specific operating entity and governing jurisdiction will be confirmed before public launch.
